Negotiations are part of everyones daily lives. In our opinion, it is one of the most critical functions of being successful in your Business and Commercial ventures. Negotiations done without appropriate preparations, understanding of the opposing parties interests can be fatal. Negotiation should be a non-emotional experience and should be approached without getting emotionally involved. This is often not the case. We have seen emotions fly bright and high in Negotiations. It sometimes is unavoidable when you are, for instance, negotiating the sale of your own company that you founded, or a business you built with your sweat. When it comes to Negotiating, It is always a good idea to be represented properly by Attorney's that understand the 'Negotiating Game'. 
THE STAKES ARE HIGH IN NEGOTIATION SITUATIONS
When the stakes are high. Leaving ego's and emotions at the door and not on the table is always a great start. We always advice our clients on this. We address this during our first meeting with our clients. Ego's and emotions are deal breakers, and we take every precaution so that we can to control this from the onset. We do this by remind our clients to focus on the big picture and not get held down by the small issues. 
HOMEWORK IS KEY | PREPARATION
If there was a time to do research and prepare yourself it is before getting to the negotiation table. Spend time to research the opposing party. Know who they are and their strengths and weaknesses. Talk to people, associates, business partners who might have dealt with them before. Create a checklist of all your opponents, this will give you a road map and hints on styles that may be used against you on the table. 
PRICE POINTS | GOALS
Before the parties come to the table and begin negotiations, price points, end results and goals are likely to have been discussed and determined. Most of the time it will in ranges rather than a single price point. This is where your homework and preparation can pay off. Studying the opposing parties previous deals can sometimes be helpful. A word of caution, you have to be realistic-there are constraints in place for every business such as ongoing business expenses, sales goals, growth projections, management, product demand and brand perception. Take these into consideration when determining your Price Points and Goals.  
ALWAYS HAVE A STRATEGY
Negotiations is a science. There are strategies and principles you want to at the very least be aware of. Depending on the situation one or more strategies and principles may need to be applied. When meeting with our clients we take the time to get to know the entire deal. We often ask our clients if there is anything else you would like. You have to ask for it if you want it. If you leave something off the table it will not be considered. A good strategy is to never disclose your full capacity or budget at the onset. We recommend never revealing such position before, during or even after the negotiations. Some things are to sacred to be disclosed. 

Doing your homework and preparing will also help you find leverage. Leverage is important in formulating a strategy to your negotiation approach, price points and more. 
NEGOTIATIONS CAN RESULT IN A WIN-WIN 
Negotiations should not be thought of as a win-lose position. It should be thought of as a win-win. All parties to a negotiation can win. Managing expectation, priorities, influences and sincere behavior can lead to a conclusion that is both satisfactory and all parties can leave with a sense of a win.
